Copyright & Terms of Use

All sculptures, reliefs, drawings, installations, photographs and any other artistic work created by Paul Klerr (Rome, 1937 – 2017) are protected by copyright. Copyright is held by the Estate of Paul Klerr, in accordance with Italian copyright law (Legge 22 aprile 1941 n. 633), the European Union acquis, the Berne Convention and the United States Copyright Act.

Under Italian and European law, copyright endures for the lifetime of the author plus seventy (70) years after death. The works of Paul Klerr will therefore remain in copyright until 31 December 2087.

The Estate also retains the moral rights of the author (diritti morali) recognised by Italian law (artt. 20–24 LDA), including the right to be identified as author and the right to the integrity of the work, which are perpetual and inalienable.

The structure, design, biographical texts, descriptive texts, catalogue entries, exhibition histories and any other editorial content of this website are © Estate of Paul Klerr.

Critical writings by third parties (Edith Schloss, Valentino Zeichen, Francesco Moschini, Claudia Terenzi, Jacopo Benci, Filiberto Menna, Barbara Tosi and others) reproduced in scanned form remain the copyright of their respective authors, publishers or successors. The Estate publishes them here for documentary and educational purposes under the principles of fair quotation and right of citation (art. 70 LDA in Italy; fair use in the United States).

The following uses of images and texts from this website are permitted, provided they include full citation as set out in Section 5 below:

• Editorial and journalistic use in newspapers, magazines and online publications, in the context of articles, reviews, news and current affairs;
• Academic and scholarly use for university theses, dissertations, peer-reviewed articles, conference papers, lectures and educational materials;
• Critical use in art criticism, art history and museum studies, including illustration of essays, monographs and exhibition catalogues with proper citation;
• Personal sharing on social media, blogs and personal websites, with credit and a link back to paulklerr.com;
• Educational use in classrooms, museums and cultural institutions for teaching and study purposes.

The following uses require prior written authorisation from the Estate. Please write to info@paulklerr.com with a description of the intended use, the medium, the print run or distribution, and the territory.

• Commercial use of images, including stock photography, prints, posters, postcards, merchandise and any kind of derivative product;
• Reproduction in books, monographs, exhibition catalogues, encyclopaedias and reference works (whether commercial, academic or institutional);
• Use in advertising, sponsorship, fundraising or promotional campaigns;
• Public exhibition of original works (loans, retrospectives, group shows);
• Reproduction in film, television, documentaries, or other audiovisual production;
• Reproduction by museums or galleries on physical or digital displays of their permanent or temporary collections;
• Generation of NFTs, blockchain-based works, or other digital assets;
• Use of the works or their reproductions for the training of artificial intelligence models, machine learning systems, or generative AI of any kind, whether for commercial or research purposes. No such use is authorised, and the Estate expressly reserves all rights under the EU Directive on Copyright in the Digital Single Market (2019/790, art. 4) to opt out from text and data mining for AI training.

When citing or reproducing a work of Paul Klerr, please use the following formula:

For shorter contexts (social media, captions, brief mentions), the minimum credit must include: artist name, title, year, © Estate of Paul Klerr.

For all uses requiring authorisation (Section 4), or for high-resolution image requests for editorial use, please write to info@paulklerr.com, providing:

• Full name and affiliation of the requester (publisher, institution, individual);
• Detailed description of the intended use (publication, exhibition, project);
• Specific work(s) to be reproduced (with title and year if known);
• Format (print, digital, both), print run / circulation, format / size;
• Geographical territory and duration of the licence;
• Deadline by which a response is needed.

The Estate generally responds within 10 working days. Authorisation may be granted free of charge for academic, journalistic and non-commercial editorial uses. Commercial uses are subject to a licence fee, determined case by case.

Unauthorised use of the works of Paul Klerr or of the content of this website constitutes copyright infringement and may give rise to civil and criminal proceedings under Italian, European and international law.

If you believe that a work of Paul Klerr is being used without authorisation, or if you wish to report an infringement of the Estate's rights, please write to info@paulklerr.com. The Estate is committed to defending the integrity of the work and the moral and economic rights of the artist.

This page and any matter arising from it are governed by the laws of the Italian Republic. Any dispute shall fall under the exclusive jurisdiction of the courts of Rome, Italy.

The Estate of Paul Klerr reserves the right to update these terms at any time. The latest version will always be published on this page.
